TradingTune is a browser extension that automates parameter optimization and backtesting for trading strategies on TradingView, running entirely inside your own web browser. We built TradingTune to be private by design: your trading strategies, parameter ranges, optimization runs, and results are processed locally on your device and are never transmitted to, uploaded to, or stored on any TradingTune server. Running optimizations does require a free account and sign-in, and to enforce the free daily allowance the extension sends us only your account identifier and your per-day optimization-cycle count (see Section 4). This Privacy Policy explains what limited information the TradingTune browser extension and the TradingTune website (tradingtune.com) handle, how it is used, the legal bases we rely on, and the rights you have. Because the extension and the website have different data practices, we describe each separately below.

1. Introduction and scope

This Privacy Policy applies to two distinct things, treated separately because their data practices differ:

  • The TradingTune browser extension, a Chrome / Brave (Manifest V3) extension that runs locally in your browser to optimize and backtest trading strategies on TradingView.
  • The TradingTune website, the marketing and informational website at tradingtune.com, which is a static website.

"TradingTune," "we," "us," and "our" refer to TradingTune Support Team, the provider of TradingTune. "You" refers to the user of the extension or visitor to the website. TradingTune is an independent product and is not affiliated with, endorsed by, or sponsored by TradingView, Inc. Your use of TradingView itself is governed by TradingView's own terms and privacy policy, which we do not control.

2. Our core principle: local-first, privacy by design

The most important thing to understand about TradingTune is that the extension does its strategy work entirely within your browser.

  • Your strategies, the parameter ranges you configure, your optimization runs, and the backtest results are all processed locally on your device.
  • This data is stored only in your browser's local extension storage on your own computer.
  • Your strategy data stays local and is never sent to us. We operate no backend server that ingests, receives, collects, or stores your strategies, parameters, runs, or results, and there is no cloud sync of your strategies to us.
  • Separately, running optimizations requires a signed-in account. To enforce the free daily allowance, we receive only your account identifier and your daily optimization-cycle count. We do not receive your strategy data as part of this. This account and usage data is described in Section 4.

In short: your trading data stays on your machine. We designed the product so that we never need to see it, and we do not; the only extension data we receive is your account ID and your daily cycle count.

3. What the extension accesses, and why

TradingTune is a tool that you operate within your own browser, on the pages you choose to use it on, and at your own direction. To provide its optimization and backtesting features, the extension works with the content of the current page in your browser (the page's DOM) so that, while you are using it, it can:

  • display its own controls so you can configure and start a run;
  • read and update the strategy input values you are working with; and
  • read the results shown on the page so it can summarize and compare them for you.

All of this happens locally, inside your browser, in real time, and only while you are using the extension. The extension also uses your browser's local extension storage to save your settings, configurations, runs, and results so they persist between sessions. That storage lives on your device.

Your control and responsibility. You decide how, when, and where to use the extension. TradingTune provides the tooling only; it does not act on your behalf and does not control any third-party website or service you choose to use it with. You are solely responsible for your use of the extension, including ensuring that your use complies with the terms, policies, and rules of any third-party platform you use it with (for example, TradingView).

What the extension does not do:

  • It does not send your strategies, parameters, runs, or results to TradingTune or any third party.
  • It does not harvest, log, or transmit your general browsing history, and it does not track the other websites you visit.
  • It does not require, request, or store any TradingView API keys or credentials (TradingTune uses no API keys).
  • It does not sell your data or share it for advertising.

Running optimizations does require a free account and sign-in: the extension authenticates you and reports your daily optimization-cycle count to enforce the free daily allowance (see Section 4). Even so, it still never uploads your strategies, parameters, runs, or results.

4. Accounts, authentication, and usage data

Running optimizations requires a free account, including on the Free tier. This is the one part of the extension experience where limited data leaves your browser, and it is deliberately narrow.

  • Account and sign-in. You create and sign in to an account using Firebase Authentication (a Google service). Authentication issues your account an identifier.
  • What we receive and store. To enforce usage limits, the extension reports your daily optimization-cycle count, keyed by your account identifier, to a backend (a Google Cloud Run function) that stores it in Google Firestore. The only extension data we receive is your account identifier and that per-day cycle count.
  • Purpose. We use this data solely to enforce the Free tier daily allowance (a cap of up to ten (10) optimization cycles per day) and, in future, to manage subscription entitlement. We do not use it for advertising or profiling.
  • Strategy data is not part of this. Your strategies, parameter ranges, optimization runs, and results stay on your device and are never uploaded. They are not sent to Firebase Authentication, Cloud Run, or Firestore.

Legal bases (GDPR / UK GDPR). We process your account identifier and cycle count on the bases of performance of a contract (Art. 6(1)(b)), to provide the Service you have signed in to use and to administer your tier, and our legitimate interests (Art. 6(1)(f)), to enforce usage limits, prevent abuse, and keep the Service sustainable.

Retention. We keep your account identifier and cycle count while your account is active. When your account is closed, or after it has been inactive for a period, this data is deleted or anonymized, except where we must retain limited records to comply with law or prevent abuse.

5. What the website collects

The TradingTune website (tradingtune.com) is a static website, separate from the extension, and does not have access to anything inside the extension or to your trading data.

  • Analytics: the website uses two analytics tools. Cloudflare Web Analytics is privacy-friendly and cookieless, recording aggregate page views only. Google Analytics 4, provided by Google, measures how visitors use the site (pages viewed, navigation paths, and on-page interactions such as clicks) so we can improve it; it sets first-party cookies (named _ga and _ga_*) in your browser and is loaded only after your first interaction with the page. We do not use it for cross-site advertising. You can opt out using Google's browser add-on at https://tools.google.com/dlpage/gaoptout, or by blocking analytics at the browser or extension level.
  • Cookies: the website uses strictly necessary cookies plus the first-party analytics cookies set by Google Analytics described above. We do not display a cookie banner; where consent is legally required for analytics cookies, we rely on the legal bases in Section 8, and you may opt out as described above. We do not use cookies for advertising.
  • Waitlist: if you choose to join the waitlist and submit your email address, that email is collected and processed by Kit (ConvertKit) so we can notify you about the launch and send product updates. Providing it is optional and based on your consent; you can unsubscribe at any time using the link in any email we send.
  • Server logs: our hosting provider, Cloudflare, may generate standard server logs (such as IP address, browser type, and pages requested) for delivering the website, security, and abuse prevention, retained only as needed.

6. Payment data (Pro tiers)

Payments for the paid Pro tiers ($29/month, $299/year, $599 lifetime) will be processed by a third-party payment provider (such as Stripe or a Merchant of Record), which acts as an independent controller and/or our processor for payment handling. Paid plans are not yet active; this section describes how billing will work once paid Pro is enabled.

  • You provide your payment details directly to the payment processor, not to us, and they are handled under that processor's own privacy policy and terms.
  • TradingTune does not receive or store your full payment card number, card security code, or full banking details.
  • What TradingTune typically receives is limited to information needed to grant and manage your license, such as your email address, your subscription or purchase status, and a license key or token, plus limited transaction metadata for accounting and support.

If your purchase is handled by a Merchant of Record, that entity may be the seller of record and may handle tax and billing under its own policies.

7. Pro license and email handling

If you purchase a Pro tier, your license may be tied to an email address and/or a license key. We use this limited information only to issue, validate, and manage your license; to provide support relating to your purchase; and to send essential transactional messages (such as your license key, renewal or expiration notices, or important service changes). We do not send marketing emails without an appropriate legal basis or your consent where required, and we keep this information to the minimum necessary.

8. Legal bases for processing (GDPR / UK GDPR)

For users in the EEA and the UK, and because TradingTune is local-first the personal data we actually process is minimal, we rely on:

  • Performance of a contract (Art. 6(1)(b)): to provide the Service you sign in to use, administer your account and tier, provide the Pro tier, manage your license, and process payment through our processor.
  • Legitimate interests (Art. 6(1)(f)): to operate, secure, and maintain the website and licensing system, enforce usage limits, prevent fraud and abuse, and provide support.
  • Consent (Art. 6(1)(a)): where required, for non-essential cookies or analytics, or optional marketing. You may withdraw consent at any time.
  • Legal obligation (Art. 6(1)(c)): to comply with legal, tax, and accounting requirements.

The extension's processing of your strategy data happens locally on your device and is under your control; we do not receive that data on our servers. The only extension data we receive is your account identifier and your daily optimization-cycle count, as described in Section 4.

9. How we use data

We use the limited data described here only to provide and maintain the extension and website; create and authenticate your account and enforce the Free tier daily allowance using your account identifier and daily optimization-cycle count; grant and manage Pro licenses and process payments; respond to support and send essential transactional messages; maintain security and prevent fraud; and comply with law. We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We do not disclose your trading strategies, parameters, or results to anyone, because we never receive them in the first place; the only extension data we receive is your account ID and your daily cycle count.

10. Third parties and sub-processors

  • Accounts and usage data: Google (Firebase Authentication, Cloud Run, Firestore), for account sign-in and to store your account identifier and daily optimization-cycle count.
  • Payment processing: not yet integrated. The Pro tiers are pre-launch; when paid plans go live, a third-party payment processor will be listed here for payments and, where applicable, billing and tax.
  • Website hosting: Cloudflare, for hosting the static website.
  • Analytics: Cloudflare (Cloudflare Web Analytics, cookieless) and Google (Google Analytics 4), for aggregate and event-level visitor metrics.
  • Email / support: support is handled in-house at support@tradingtune.com; waitlist sign-ups and the launch and product-update emails are processed and delivered by Kit (ConvertKit, by Kit.com, Inc.).

Each processes data under its own privacy terms. We do not share your trading strategy data with any of them, because that data never leaves your browser.

11. Data retention and security

Retention. Extension data (settings, runs, results) is stored locally in your browser for as long as you keep it; you can delete it at any time, and we do not retain it because we never receive it. Account and usage data (your account identifier and daily optimization-cycle count) is kept while your account is active and is then deleted or anonymized when your account is closed or after a period of inactivity, except where limited records must be retained to comply with law or prevent abuse. License and payment-related data (such as your email, license key, and transaction records) is retained while your license is active and thereafter only as long as necessary for support, fraud prevention, and legal, tax, and accounting compliance, after which it is deleted or anonymized. Website server logs are retained only as long as needed for security and operations.

Security. We take reasonable technical and organizational measures to protect the limited data we handle. The local-first architecture itself reduces your exposure: because your strategy data and results stay on your own device and are never centralized on our servers, there is no central store of your strategies for us to lose or for an attacker to target. The account and usage data we do hold (your account identifier and daily cycle count) is handled by Google (Firebase Authentication, Cloud Run, Firestore) under its own industry-standard controls, and payment data is handled by our payment processor under its own controls (such as PCI-DSS). No method of transmission or storage is 100% secure, but we work to protect the information involved.

12. Your privacy rights

Depending on where you live, you may have the following rights. Because the extension stores most data locally, you can also control it yourself at any time.

EEA / UK (GDPR / UK GDPR): the rights to access, rectification, erasure, data portability, to object to processing based on legitimate interests, to restrict processing, to withdraw consent, and to lodge a complaint with your local supervisory authority.

California (CCPA / CPRA): the rights to know, delete, and correct personal information, to opt out of the sale or sharing of personal information for cross-context behavioral advertising (we do not sell or share it in this way, so there is nothing to opt out of, but you retain the right), and to non-discrimination for exercising your rights.

Self-service control (everyone): because the extension keeps your strategies, settings, runs, and results in your browser's local storage, you can clear that data yourself at any time by removing the extension and/or clearing its local storage through your browser's settings.

How to exercise your rights: contact us at support@tradingtune.com. We will respond within the timeframes required by applicable law and may need to verify your identity first. You may use an authorized agent where the law permits.

13. International data transfers

TradingTune is available worldwide. The limited data we handle may be processed in countries other than your own, including by our third-party providers. Where data is transferred out of the EEA or the UK, we rely on appropriate safeguards as required by law, such as Standard Contractual Clauses, the UK International Data Transfer Addendum, and/or adequacy decisions. Contact us for more information about these safeguards.

14. Children's privacy

TradingTune is intended for adults and is not directed to anyone under the age of 18. We do not knowingly collect personal information from minors. If you believe a minor has provided us with personal information, contact us at support@tradingtune.com and we will take appropriate steps to delete it.

15. Chrome Web Store / limited use compliance

The TradingTune extension complies with the Chrome Web Store Developer Program Policies, including the Limited Use requirements, and follows Manifest V3 standards. The extension's access to page content (the TradingView DOM) and local storage is limited to providing and improving the extension's user-facing features, optimization and backtesting on TradingView. The only data the extension transmits to us is your account identifier and your daily optimization-cycle count, used solely to authenticate you and enforce usage limits; we do not receive your strategies, parameters, runs, or results. We do not sell this data and do not transfer or use it for any unrelated purpose, including advertising, credit assessment, or building user profiles. The extension's data handling is consistent with the disclosures in this Privacy Policy and on the Chrome Web Store listing.

16. Changes to this policy

We may update this Privacy Policy from time to time. When we make changes, we will update the "Last updated" date above and post the revised version on tradingtune.com. If the changes are material, we will provide a more prominent notice where appropriate (for example, via the extension or by email to Pro users where we have a license email on file). Your continued use after an update takes effect constitutes acceptance of the revised policy, where permitted by law.

17. Contact / data controller

The data controller responsible for your information is TradingTune Support Team, email support@tradingtune.com. An EU/EEA representative under Art. 27 GDPR has not been designated; the controller is contactable at support@tradingtune.com. This Privacy Policy is governed by the laws of the jurisdiction of the operator's principal place of business, without prejudice to any mandatory consumer or data protection rights you have in your country of residence.

Terms of Service

These Terms of Service ("Terms") form a binding legal agreement between you ("you," "your," or "User") and TradingTune Support Team ("TradingTune," "we," "us," or "our"), the operator of the TradingTune browser extension and the website at tradingtune.com (together, the "Service"). Please read these Terms carefully. They contain important provisions that affect your legal rights, including an assumption of risk regarding your use of TradingView, a no-financial-advice and trading-risk disclaimer, a strict no-refund policy, disclaimers of warranties, and a limitation of our liability. By installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not install or use the Service.

1. Acceptance of terms; eligibility

By installing, accessing, or using the Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and by any documents expressly incorporated by reference, including our Privacy Policy. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes that organization.

You represent and warrant that you are at least 18 years of age (or the age of majority in your jurisdiction, if higher) and that you have the full legal capacity and authority to enter into these Terms. You further represent that you are not barred from using the Service under any applicable law, and that you are not located in, and will not use the Service in, any country or region subject to comprehensive sanctions or embargoes, or while you are a person with whom dealings are prohibited under applicable law. The Service is not directed to and may not be used by anyone under 18.

2. Description of the service

TradingTune is a browser extension for Chromium-based browsers (including Google Chrome and Brave) built on the Manifest V3 platform. The Service is designed to assist with parameter optimization and backtesting of trading strategies on the third-party platform TradingView.

The Service operates entirely within your own web browser (client-side). It functions by injecting its own user-interface panel into TradingView's strategy settings dialog, programmatically setting strategy input parameters, triggering TradingView's own backtesting functionality, and reading the results that TradingView displays in your browser. TradingTune does not operate any server that receives, processes, stores, or executes your trading strategies, and TradingTune does not place trades, connect to brokerages or exchanges, or require any API keys.

The Service is offered in a Free tier (which requires a free account and sign-in and is subject to usage limits, including a cap of up to ten (10) optimization cycles per day) and in paid "Pro" tiers (described in Section 7). We may change, add, suspend, or remove features of the Service at any time as described in Section 14.

2A. Accounts and registration. To run optimizations, including on the Free tier, you must create and sign in to a free account. You agree to provide accurate and complete information, to keep your account credentials secure and confidential, and that you are responsible for all activity that occurs under your account. You may hold one account per person. We may suspend or terminate accounts for any breach of these Terms (see Section 13).

3. License grant; reservation of rights

Subject to your continuous compliance with these Terms, TradingTune grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use one copy of the Service on browsers and devices that you own or control, solely for your own personal or internal business use and solely for its intended purpose.

This is a license, not a sale. All rights not expressly granted to you in these Terms are reserved by TradingTune and its licensors. You acquire no ownership interest in the Service or in any portion of it by virtue of these Terms or your use of the Service.

4. Acceptable use and restrictions

You agree that you will not, and will not permit, enable, or encourage any third party to:

  • copy, modify, adapt, translate, or create derivative works of the Service, except as expressly permitted by these Terms or by mandatory applicable law;
  • reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, underlying ideas, or algorithms of the Service, except to the limited extent applicable law expressly permits despite this limitation;
  • rent, lease, lend, sell, resell, sublicense, distribute, publish, or otherwise make the Service available to any third party, or use the Service to provide a service to third parties;
  • remove, alter, or obscure any proprietary notices (including copyright or trademark notices) in or on the Service;
  • circumvent, disable, bypass, or otherwise defeat any usage limits, tier restrictions, license checks, authentication, or other technical protection or entitlement measures (including the Free tier daily optimization-cycle limit), or access paid functionality without paying for it;
  • use any robot, scraper, or other automated means, or any unauthorized script or integration, to abuse, overload, or interfere with the Service, or to extract data in a manner not intended by the Service;
  • use the Service to develop, train, or improve a competing product or service;
  • use the Service in any way that is unlawful, fraudulent, deceptive, or harmful, or that violates the rights of any third party or any applicable law, rule, or regulation (including securities, financial-services, market-conduct, anti-money-laundering, export-control, and sanctions laws); or
  • use the Service in violation of the terms, policies, or technical limitations of any third-party platform with which it interacts, including TradingView.

We may, but are not obligated to, monitor use of the Service and may investigate and take appropriate action against any suspected violation, including suspending or terminating your access (see Section 13).

5. TradingView interaction; independence; assumption of risk

This Section is important. Please read it carefully.

Independence and trademarks. TradingTune is an independent third-party tool. TradingTune is not affiliated with, associated with, authorized by, endorsed by, sponsored by, or in any way officially connected with TradingView, Inc. or any of its subsidiaries or affiliates. "TradingView" and any related names, marks, and logos are the trademarks of their respective owners and are used only nominatively to describe interoperability.

How the Service interacts with TradingView. You understand and acknowledge that the Service works by modifying the TradingView web interface as it is rendered in your own browser, by injecting its own interface elements, and by programmatically driving TradingView's controls and reading TradingView's displayed results. The Service does this on your device, under your direction, using your own TradingView session.

Your sole responsibility for compliance. You acknowledge and agree that automating, scripting, injecting into, or otherwise programmatically interacting with TradingView may be subject to, restricted by, or in conflict with TradingView's own terms of service, policies, and acceptable-use rules. It is your sole responsibility to review TradingView's terms and policies and to ensure that your use of the Service complies with them. You assume all risk arising from your use of the Service in connection with TradingView.

No responsibility for TradingView's conduct or actions against you. TradingTune does not control TradingView and is not responsible for TradingView's platform, content, availability, terms, or conduct. Without limitation, TradingTune is not responsible or liable for: (a) any change, update, redesign, or restriction that TradingView makes to its website, interface, features, or rules that degrades, breaks, limits, or prevents the operation of the Service; or (b) any action that TradingView (or any other third party) may take against you, your TradingView account, or your data, including warning, throttling, restricting, suspending, or terminating your account, as a result of or in connection with your use of the Service. You assume all such risk, and you agree that any such event does not entitle you to any refund or credit (see Section 7).

6. No financial advice; trading-risk disclaimer

This Section is important. Please read it carefully.

Research and testing tool only. The Service is a research, testing, and optimization utility. It does not, and is not intended to, provide financial, investment, trading, legal, tax, or accounting advice, and nothing produced by, displayed in, or derived from the Service constitutes a recommendation, solicitation, or offer to buy, sell, or hold any security, derivative, currency, digital asset, or other financial instrument, or to adopt any trading or investment strategy. TradingTune is not a broker-dealer, investment adviser, commodity trading advisor, or financial institution, and no fiduciary or advisory relationship is created by your use of the Service.

Hypothetical and historical results. Any backtest, optimization, simulation, or performance result generated, surfaced, or processed through the Service is hypothetical and based on historical data. Past performance and hypothetical performance are not indicative of and do not guarantee future results. Optimized parameters are derived from historical data and are prone to overfitting (curve-fitting): a strategy that performs well on historical data may perform poorly, or cause losses, in live trading. Hypothetical results have inherent limitations, including that they are prepared with the benefit of hindsight and do not account for real-money execution, fees, slippage, liquidity, latency, or market impact.

Trading risk. Trading and investing involve substantial risk of loss and are not suitable for every person. You may lose some or all of your capital. You are solely and exclusively responsible for evaluating the merits and risks of any strategy, parameter set, trade, or investment, for any decision you make, and for all resulting outcomes. You should consult your own licensed financial, legal, and tax advisors before making any trading or investment decision. To the maximum extent permitted by law, TradingTune has no liability for any trading or investment losses or other outcomes arising from your use of, or reliance on, the Service or its outputs.

7. Payments; pricing; strict no-refund policy

Pricing tiers. The Free tier is provided at no charge and is subject to the limitations described in Section 2. Paid "Pro" tiers provide unlimited optimization cycles and are offered, as currently planned, at the following prices: USD $29 per month (monthly subscription), USD $299 per year (annual subscription), and USD $599 as a one-time payment for a lifetime plan (see Section 8). Prices are stated exclusive of taxes unless otherwise indicated and are subject to change as described in Section 14.

Payment processing. Payments are or will be processed by one or more third-party payment processors or a merchant of record (for example, Stripe or a comparable provider). By purchasing, you also agree to the applicable processor's terms. TradingTune does not collect, process, or store your full payment-card details; that information is handled by the payment processor. You represent that any payment information you provide is accurate and that you are authorized to use the payment method.

Subscriptions and auto-renewal. Subscription plans (monthly and annual) are billed in advance and automatically renew for successive periods of the same length at the then-current price, unless and until you cancel before the end of the current period. By subscribing, you authorize us and our payment processor to charge your payment method on a recurring basis for each renewal term until you cancel. You can cancel as described in Section 8.

Taxes. You are responsible for all applicable sales, use, value-added, goods-and-services, withholding, and similar taxes, duties, and government charges associated with your purchase, excluding taxes based on our net income. Where we or our merchant of record are required to collect such taxes, they will be added to the amount charged.

Immediate performance and digital-goods nature. You acknowledge that the Service is a digital product that delivers its value immediately upon purchase: upon payment you receive immediate access to the paid functionality, which you may use to optimize and test your strategies right away. The benefit you receive is realized on use and cannot be returned.

All sales are final, no refunds. To the maximum extent permitted by applicable law, all payments and purchases are final and non-refundable. We do not provide refunds, credits, or proration for any reason, including (without limitation): partially used or unused periods; dissatisfaction with results, performance, or outputs; lack of profit or trading losses; your failure to use the Service; changes TradingView makes that affect the Service; any action TradingView or any other third party takes against you or your account; your loss of access due to violation of these Terms; or your change of mind. You acknowledge that this no-refund policy is a material part of the bargain and is reflected in the pricing.

Statutory withdrawal rights and express consent to immediate performance. Some jurisdictions grant consumers a statutory right to withdraw from or cancel a purchase within a set period. Where such a right applies and is capable of being waived or extinguished by performance, you expressly request and consent that we begin performance and provide you immediate access to the paid functionality immediately upon purchase, and you acknowledge and agree that you thereby lose any such statutory right of withdrawal, cancellation, or refund once access has begun. Where a statutory refund or withdrawal right is non-waivable, nothing in these Terms limits that right to the extent it cannot lawfully be limited, but our no-refund policy applies to the fullest extent the law permits.

Chargebacks. If you initiate a chargeback, payment dispute, or reversal in respect of a charge that was validly incurred under these Terms, we reserve the right to immediately suspend or terminate your access to the Service and any associated entitlement (including a lifetime plan), to dispute the chargeback and submit these Terms and your acceptance as evidence, and to recover any resulting costs and fees. Initiating an improper chargeback is a breach of these Terms.

Failed payments. If a renewal or other charge fails, we may retry the charge and may suspend or downgrade your access (for example, to the Free tier) until payment is resolved.

8. Cancellation; lifetime plan scope

Cancellation of subscriptions. You may cancel a monthly or annual subscription at any time through the cancellation mechanism we provide (for example, a billing portal, account settings, or by contacting us at support@tradingtune.com). Cancellation stops future renewals and the associated future charges. Cancellation takes effect at the end of your then-current paid period; you will retain paid access until the end of that period, after which your access will revert to the Free tier (or terminate). Consistent with Section 7, cancellation does not entitle you to any refund or proration for the current or any prior period.

Lifetime plan. The lifetime plan is a single, one-time payment that grants you access to the then-available Pro functionality, including updates, bug fixes, and improvements that we release for the Service, for the operational lifetime of the Service. "Lifetime" refers to the commercially reasonable life of the TradingTune product, not to the life of any person, and it does not create a perpetual obligation on us to maintain, operate, or support the Service indefinitely. If we permanently discontinue the Service in its entirety (see Sections 13 and 14), the lifetime plan ends without any refund obligation, except as required by non-waivable law. The lifetime plan is personal to you, is non-transferable, and does not include any product that we reasonably designate and offer as a separate or successor product rather than an update to the Service.

9. Intellectual property

The Service, including all software, code, designs, user interfaces, text, graphics, logos, and other content (excluding your own data and any third-party content), and all intellectual property rights in and to the foregoing, are and will remain the exclusive property of TradingTune and its licensors and are protected by copyright, trademark, and other laws. "TradingTune" and the TradingTune logo are trademarks of TradingTune Support Team. These Terms grant you only the limited license in Section 3 and do not transfer any intellectual property rights to you. If you provide us with any feedback or suggestions about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free, fully paid-up license to use and exploit that feedback for any purpose without obligation to you.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRADINGTUNE AND ITS SUPPLIERS AND LICENSORS DISCLAIM ALL WARRANTIES, REPRESENTATIONS, AND CONDITIONS, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE FOREGOING, TRADINGTUNE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT IT WILL FUNCTION ON ANY PARTICULAR BROWSER, DEVICE, OR VERSION OF TRADINGVIEW, OR WILL CONTINUE TO FUNCTION IF TRADINGVIEW OR YOUR BROWSER CHANGES; THAT DEFECTS WILL BE CORRECTED; OR THAT ANY RESULTS, OUTPUTS, CALCULATIONS, OR DATA OBTAINED THROUGH THE SERVICE WILL BE ACCURATE, COMPLETE, RELIABLE, OR SUITABLE FOR ANY PURPOSE. ANY MATERIAL OBTAINED THROUGH THE SERVICE IS USED AT YOUR OWN DISCRETION AND RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL TRADINGTUNE OR ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS, OR FOR ANY TRADING OR INVESTMENT LOSSES, OR LOSS ARISING FROM ANY ACTION TAKEN BY TRADINGVIEW OR ANY OTHER THIRD PARTY AGAINST YOU OR YOUR ACCOUNT, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE, OR ANY OTHER THEORY, AND EVEN IF TRADINGTUNE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF TRADINGTUNE AND THE PARTIES LISTED ABOVE FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU ACTUALLY PAID TO TRADINGTUNE FOR THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED. YOU ACKNOWLEDGE THAT THESE LIMITATIONS ARE AN ESSENTIAL BASIS OF THE BARGAIN AND THAT PRICING REFLECTS THIS ALLOCATION OF RISK.

12. Indemnification

You agree to defend, indemnify, and hold harmless TradingTune and its owners, officers, directors, employees, contractors, agents, suppliers, and licensors from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use or misuse of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation, or of any third party's rights, including TradingView's terms; (d) your trading, investment, or other decisions and their outcomes; or (e) any content or data you submit, process, or generate through the Service. We may assume the exclusive defense and control of any matter subject to indemnification by you, at your expense, in which case you agree to cooperate. This obligation survives termination.

13. Termination and suspension

You may stop using the Service and uninstall the extension at any time, and you may cancel any subscription as described in Section 8. We may suspend or terminate your access to the Service (in whole or in part, including any paid entitlement), with or without notice, if we reasonably believe that: (a) you have violated these Terms; (b) your use creates risk or possible legal exposure for us, other users, or any third party; (c) you have initiated an improper chargeback; or (d) we are required to do so by law. Upon termination, the license granted to you in Section 3 immediately ends and you must cease all use of the Service. Termination does not entitle you to any refund (see Section 7), except as required by non-waivable law. Sections that by their nature should survive termination will survive.

14. Modifications to the terms, the service, and pricing

Changes to the Terms. We may modify these Terms from time to time. If we make material changes, we will provide reasonable notice by updating the "Last updated" date above and, where appropriate, by posting a notice on tradingtune.com. Changes are effective when posted (or on a later stated effective date). Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

Changes to the Service and pricing. We may add, modify, suspend, or discontinue any part of the Service at any time, with or without notice, and we may change our prices and fee structures. For active subscriptions, price changes apply to renewal periods that begin after we provide reasonable advance notice. Price changes do not affect amounts already paid and do not create any refund right.

15. Third-party services

The Service interacts with and depends on third-party services and platforms that we do not own or control, including TradingView, your browser and its extension store, our payment processor or merchant of record, Google Analytics (website usage analytics), and Kit (ConvertKit, for the optional email waitlist). Your use of those third-party services is governed by their own terms and policies, and you are responsible for complying with them. TradingTune does not endorse and is not responsible or liable for any third-party service, including its availability, accuracy, content, security, terms, or conduct, or for any change a third party makes that affects the Service.

16. Governing law; dispute resolution

These Terms and any dispute or claim arising out of or relating to them or the Service are governed by the laws of the jurisdiction of the operator's principal place of business, without regard to its conflict-of-laws rules and excluding the United Nations Convention on Contracts for the International Sale of Goods. You and TradingTune agree that the competent courts of that jurisdiction will have exclusive jurisdiction over any dispute, and you consent to the personal jurisdiction of, and venue in, those courts. To the extent permitted by law, any claim arising out of or relating to these Terms or the Service must be filed within one (1) year after the claim arose, or it is permanently barred. Nothing in this Section limits any non-waivable right you have under the mandatory consumer-protection laws of your country of residence.

17. General provisions

If any provision of these Terms is held invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed, and the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of it. These Terms, together with the Privacy Policy, constitute the entire agreement between you and TradingTune regarding the Service and supersede all prior agreements. You may not assign these Terms without our consent; we may assign them freely, including in connection with a merger or sale of assets. Nothing here creates any agency, partnership, joint venture, or employment relationship. TradingTune is not liable for any delay or failure to perform resulting from causes beyond its reasonable control, including third-party platform changes or outages.
